Welcome to The Studio: by Sessions Boutique — a global platform that connects Users with world-class Musicians and Providers for real-time, live remote recording sessions.

By creating an account or using the app, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.

1. Company Information

The Studio: by Sessions Boutique ("The Studio," "we," "our," or "us") is operated by Sessions Boutique, LLC, based in Tampa, Florida, United States.

2. Acceptance of Terms

By creating an account, subscribing, or using the app in any way, you acknowledge that you have read, understood, and agreed to these Terms.

If you are using the app on behalf of a business or organization, you represent that you have the authority to bind that entity.

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your country) to use The Studio.

The Studio is open to Users, Musicians, and Providers worldwide, subject to applicable local laws.

4. Service Description

The Studio provides an online platform that enables Users to:

  • Book and participate in real-time, live audio/video recording sessions with Musicians and Providers.
  • Communicate with them during and after sessions.
  • Receive final audio or project files once the live session is complete.

Musicians and Providers perform their services independently through the platform.

5. Subscriptions and Payments

The Studio operates on a subscription-based model for Users:

Monthly Plan: Billed at the applicable regional rate (cancel anytime).

Annual Plan: Billed at the applicable regional rate and includes a discounted annual amount.

Pricing may vary by country or region and will always be displayed at checkout before you complete your purchase.

Subscribers may also receive discounts on future Add-Ons or services if made available.

Payments are processed securely through third-party providers such as Stripe.

Your subscription renews automatically unless canceled before the next billing cycle.

6. Add-Ons and Additional Services

Orchestra Recording Services

(Currently available for bookings in Brazil)

Orchestra services require a minimum 20-day advance booking to ensure availability and proper preparation. Upon payment, your session is immediately confirmed.

Cancellation & Rescheduling Policy for Orchestra Services:

  • 72+ hours before session: Full refund minus credit card processing fees
  • Within 72 hours of session: No refund (100% retained)
  • Rescheduling: One (1) free reschedule allowed if requested 10+ days before the scheduled session. Rescheduled date must be within 90 days of original booking.

Optional Add-On Services:

The following add-on services may be purchased in conjunction with orchestra bookings:

  • 1. Original Composition — Custom music composed by our team. Full rights buyout included. Requires 30+ days advance booking. Non-refundable once composition work begins.
  • 2. Scoring & Orchestration — Professional arrangement and notation services. Non-refundable once scoring work begins.
  • 3. Video Shooting — Professional filming with fixed and moving cameras. Must be booked at time of orchestra session booking. Refundable up to 72 hours before session.
  • 4. Video Editing — Post-production video editing. Non-refundable once editing work begins. Typical delivery: 7-14 business days.
  • 5. Premium Mixing and Mastering — Professional audio post-production by in-house engineers. Non-refundable once mixing work begins. Typical delivery: 7-10 business days.
  • 6. Music Production — Full production guidance from concept to final master. Non-refundable once production work begins.

All add-on services display rates and terms clearly at time of booking. All orchestra musicians and add-on service providers are independent contractors.

In the future, additional services may be introduced. If new services are activated, all terms and rates will be clearly displayed prior to booking.

7. Booking Policy and Availability

Users may book as many live sessions as they wish, subject to each Musician's or Provider's availability and the platform's scheduling capacity. The Studio operates a fair-access scheduling system designed to balance demand among Users and Musicians.

Sessions may be booked for:

  • Your own solo projects
  • Projects for your band or musical group in which you are a direct member
  • Internal projects for a company or organization you represent

You may not resell, sublicense, or share your account, subscription, or booked sessions with third parties. Using The Studio to deliver or fulfill services for third parties outside your own projects is strictly prohibited and may result in suspension or termination without refund.

The Studio aims to provide consistent and fair access to live sessions for all actively booking subscribers. While we work to maximize overall availability, actual session access may vary depending on musician schedules, time zones, instrument demand, and overall platform activity. Session availability is not guaranteed and may fluctuate based on these operational considerations.

If, despite good-faith booking attempts, a User's completed sessions fall materially below typical platform availability in a given billing cycle, The Studio may, at its sole discretion, issue a non-cash service credit (e.g., priority booking token or an additional month of service). Credits have no cash value and may expire.

To qualify for such a credit, Users must:

  • (i) submit complete session materials;
  • (ii) offer at least three (3) reasonable time windows over two (2) different days;
  • (iii) accept reassignment to other qualified Musicians or Providers when necessary; and
  • (iv) have no cancellations or no-shows in that cycle.

Force majeure events, platform maintenance, and operational constraints are excluded.

If a Musician or Provider faces an emergency more than forty (40) hours before a scheduled session, the User may submit a change request. Emergencies within forty hours require mutual agreement between User and Musician via the in-app message system to avoid a no-show designation.

7.1 Platform-Initiated Cancellations (Rare and Unforeseen Circumstances)

In rare cases, The Studio may need to cancel or reschedule a session due to unforeseen operational issues, system outages, emergency maintenance, or unexpected Musician unavailability.

If The Studio cancels a session, Users will be offered one of the following:

  • Re-book with the same Musician at the next available time;
  • Accept a replacement Musician assigned by The Studio with comparable skills; or
  • Receive a non-cash service credit, issued at The Studio's discretion.

Platform-initiated cancellations never count as User cancellations or no-shows.

7.2 Free Credits, Promotional Credits, and Trial Credits

The Studio may issue free credits for limited use. These are subject to the following:

Booking Scope: Booking Scope: Free credits may be used to book a session with any available Musician or Provider.

No Cancellations Allowed: No Cancellations Allowed: Sessions booked using free credits cannot be canceled. Any cancellation attempt results in forfeiture of the credit.

Missed Sessions / No-Shows: Missed Sessions / No-Shows: If the User misses or does not join the session, the credit is permanently lost.

Expiration: Expiration: Free credits may expire and will not be reinstated after expiration.

Non-Transferable / No Cash Value: Non-Transferable / No Cash Value: Free credits cannot be sold, transferred, or converted into monetary value or subscription payments.

Platform-Initiated Cancellations: Platform-Initiated Cancellations: If The Studio cancels a free-credit session, the User may re-book with the same Musician or a replacement. The credit will not be lost.

Free credits do not count toward availability targets and do not qualify for service credits.

8. No Refunds for Completed or Missed Live Sessions

All sessions are live and interactive, similar to in-studio experiences.

Refunds are not available once a subscription becomes active, including for completed, missed, or partially attended sessions.

An exception may apply if the User has not booked any session during the current billing cycle and submits a refund request before the cycle ends. Refunds, when granted, are at The Studio's sole discretion and may be reduced by transaction fees.

9. Communication and Conduct

All Users, Musicians, and Providers must maintain professionalism and respect.

Harassment, discrimination, hate speech, or misconduct may result in suspension or termination.

10. Independent Contractors

Orchestra musicians provided through add-on services are independent contractors, not employees or agents of Sessions Boutique.

They are responsible for their own taxes, licenses, and legal obligations.

11. Ownership and Intellectual Property

  • All platform materials (text, code, graphics, trademarks, and branding) belong to Sessions Boutique.
  • Users retain ownership of any original content or recordings they upload, subject to the licenses granted for processing and delivery.
  • Musicians participating in The Studio waive all rights in favor of the User for any audio recordings created through the app.
  • Sessions Boutique holds full written authorization from each participating Musician to grant such waivers universally and perpetually.
  • Recordings delivered through The Studio are cleared for synchronization with images (e.g., film, video, games) worldwide and perpetually, without the need for additional fees.
  • Musicians may reference their participation in portfolios or credits unless a written confidentiality agreement states otherwise.
  • For film, television, or media productions, The Studio by Sessions Boutique must be credited according to industry standards.

12. User Responsibilities

You agree not to:

  • Misuse the app or violate any law
  • Record or distribute a session without consent from all participants
  • Share your login credentials or allow others to access your account
  • Book an unreasonable number of sessions for repetitive or revision-based work
  • Advertise The Studio or its Musicians as part of your own service without permission
  • Interfere with platform security or impersonate another person

Repeated misuse may result in termination, suspension, and/or legal action.

13. Technical Requirements

Users must meet minimum technical standards:

  • 8 Mbps down / 4 Mbps up internet
  • Wired or strong Wi-Fi connection
  • Desktop/laptop recommended
  • Updated browser
  • Headphones required

The Studio is not responsible for issues caused by poor equipment or unstable connections.

14. Recording Non-Original Material (Covers, Versions, Arrangements)

  • Users may record non-original material ("covers," "versions," or "arrangements") using The Studio.
  • However, all copyright compliance is the User's sole responsibility.
  • Users warrant that they hold or have obtained necessary rights, licenses, or permissions for such use.
  • The Studio and its Musicians disclaim any liability for copyright disputes.
  • Users agree to indemnify and hold harmless Sessions Boutique and all Musicians against any claims arising from unauthorized recordings.

15. Deliverables

All deliverables are transmitted through the platform.

Large files may be exchanged through approved secure methods when necessary.

Musicians deliver clean, high-quality audio recordings.

Mixing/mastering is not included unless stated.

Users are responsible for final production and release preparation.

16. Account Security and Confidentiality

You are responsible for maintaining the confidentiality of your account credentials.

Notify us immediately of any unauthorized use.

You are liable for all activity under your account.

17. Termination

We may suspend or terminate accounts that violate these Terms or disrupt the platform.

Users may cancel subscriptions or delete their accounts at any time via account settings.

18. Right of Denial and Prohibited Content

Musicians and The Studio reserve the right to decline participation in any project that violates our ethical or content standards.

This includes, but is not limited to, material containing:

  • Pornographic or sexually explicit content
  • Hate speech, racist, sexist, or xenophobic messages
  • Discriminatory, violent, or oppressive themes
  • Any content promoting illegal or harmful activity

Users attempting to request or produce such content may have their account immediately suspended without refund.

19. Limitation of Liability

To the maximum extent permitted by law, Sessions Boutique shall not be liable for indirect, incidental, or consequential damages resulting from your use of The Studio.

Total liability shall not exceed the total amount paid by you to Sessions Boutique during the 12 months preceding the claim.

20. Governing Law

These Terms are governed by and construed under the laws of the State of Florida, United States of America. By using The Studio, you agree that any dispute shall be brought exclusively in the courts located in Tampa, Florida, USA.

21. Dispute Resolution

Disputes will first be addressed through informal negotiation.

Unresolved matters will go to binding arbitration in Tampa, Florida.

22. Changes to Terms

We may update these Terms at any time.

Significant updates will be announced via the app or by email.

Continued use of the app after updates constitutes acceptance of the revised Terms.
