Welcome to The Studio: by Sessions Boutique — a global platform that connects Users with world-class Musicians and Providers for real-time, live remote recording sessions.
By creating an account or using the app, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.
1. Company Information
The Studio: by Sessions Boutique ("The Studio," "we," "our," or "us") is operated by Sessions Boutique, LLC, based in Tampa, Florida, United States.
1.1 Platforms and Properties
Sessions Boutique, LLC owns and operates the following platforms and properties, all under a single legal entity:
- Sessions Boutique Website: sessionsboutique.com — the public-facing informational and marketing website.
- The Studio Web Application: studio.sessionsboutique.com — the web-based platform through which Users book sessions, communicate with Musicians and Providers, manage projects, and access all subscription Services.
- The Studio Mobile Application: the native mobile application available on supported platforms (such as iOS and Android), providing access to the same Services as the web application.
These Terms of Service apply equally and in full to your access and use of any and all of the above platforms, properties, and applications (collectively referred to as the "Platform"). By accessing or using any part of the Platform, you agree to be bound by these Terms.
Sessions Boutique, LLC is a single legal entity. It is not a partnership, joint venture, franchise, cooperative, or multi-entity organization. All rights, obligations, liabilities, and commitments described in these Terms belong exclusively to Sessions Boutique, LLC. No other person or entity is a party to these Terms or assumes any liability hereunder unless expressly stated.
2. Acceptance of Terms
By creating an account, subscribing, or using the app in any way, you acknowledge that you have read, understood, and agreed to these Terms.
If you are using the app on behalf of a business or organization, you represent that you have the authority to bind that entity.
3. Eligibility
You must be at least 18 years old (or the legal age of majority in your country) to use The Studio.
The Studio is open to Users, Musicians, and Providers worldwide, subject to applicable local laws.
4. Service Description
The Studio provides an online platform that enables Users to:
- Book and participate in real-time, live audio/video recording sessions with Musicians and Providers.
- Communicate with them during and after sessions.
- Receive final audio or project files once the live session is complete.
Musicians and Providers perform their services independently through the platform.
5. Subscriptions and Payments
The Studio operates on a subscription-based model for Users:
Monthly Plan: Billed at the applicable regional rate (cancel anytime).
Annual Plan: Billed at the applicable regional rate and includes a discounted annual amount.
Pricing may vary by country or region and will always be displayed at checkout before you complete your purchase.
Subscribers may also receive discounts on future Add-Ons or services if made available.
Payments are processed securely through third-party providers such as Stripe.
Your subscription renews automatically unless canceled before the next billing cycle.
Subscription Term. The subscription period begins on the date and time the initial successful payment is processed. If we restore access following a billing, payment processor, or technical error, such restoration corrects the original subscription and does not create a new subscription term or extend the billing period unless we expressly state otherwise.
5.1 Music Production, Arrangement, Mixing, Mastering, and Creative Services
Scope of Included Services
Sessions Boutique's All-Access subscription includes access to Music Production, Arrangement, Mixing, Mastering, and other creative collaboration services as part of the subscription experience. These services are intended to provide collaborative professional assistance and are subject to reasonable scope limitations.
The Services included within the All-Access subscription are designed for standard music production projects. Because every project differs in complexity, Sessions Boutique reserves the right to determine whether a requested project falls within the scope of the subscription or requires a separate custom service.
Projects that exceed the standard scope of the All-Access subscription may require a separately quoted add-on service at Sessions Boutique's sole discretion.
Service Workflow
Music Production services are generally conducted as collaborative live sessions in which the User works together with the assigned Producer in real time to develop, refine, and guide the project.
Mixing and Mastering services generally begin with an initial live session intended to discuss the User's artistic vision, creative objectives, technical preferences, reference materials, and overall expectations for the project. Following this consultation, the actual mixing and/or mastering work will ordinarily be performed independently by the assigned collaborator outside of a live session. The User is not required to be present while such work is being performed. Completed work, revisions (if applicable), and related communications will be delivered through the Sessions Boutique platform.
Arrangement services may follow a similar workflow where appropriate. Depending on the nature, complexity, and creative requirements of the project, the assigned Arranger may determine, in their professional discretion, whether all or part of the arranging process should be completed during live collaborative sessions, independently outside of live sessions, or through a combination of both approaches.
Users acknowledge that the assigned Producer, Arranger, Mixing Engineer, Mastering Engineer, or other collaborator retains reasonable professional discretion regarding the workflow used to complete the requested Services, provided such workflow remains consistent with the scope of the booked Service.
Where Sessions Boutique or the assigned Producer, Arranger, Mixing Engineer, Mastering Engineer, or other collaborator determines that subsequent work is most appropriately performed outside of a live session, the User may be required to book one or more additional sessions for completion of the requested Services.
Such booked sessions may be performed independently by the assigned collaborator without the User being present, where appropriate based on the nature of the Services. These sessions shall remain fully booked and billable sessions under the User's applicable plan, and any work performed shall be considered part of the Services. Completed work will be delivered through the Sessions Boutique platform.
Mixing & Mastering Delivery Timeline
Following the initial briefing session, the delivery timeline for completed mixing and/or mastering work will vary based on the nature and complexity of each project. As a general reference, delivery may take approximately 2 to 7 business days after the initial consultation session. This timeframe is not a guaranteed contractual deadline and may be shorter or longer depending on the scope of work, revision requirements, and other project-specific factors. Sessions Boutique will make reasonable efforts to communicate expected delivery timelines through the platform. Sessions Boutique shall not be liable for any losses, costs, or damages arising from delivery timelines falling outside this general reference range.
Standard Scope Limitation for Mixing & Mastering
The Mixing & Mastering services included within the All-Access subscription are intended for standard music production projects — typically songs with a manageable number of tracks, clean source files, and no significant pre-existing technical issues. Projects that involve audio restoration, noise removal, pitch or time correction of pre-existing recordings, extensive stem cleanup, an unusually large number of channels, audio reconstruction, severe technical damage to source files, or other requirements substantially beyond those of a standard mix or master fall outside the standard scope of the included service. Sessions Boutique reserves the right, in its sole discretion, to determine that a submitted project exceeds the standard scope and to offer a separately quoted custom service as a paid add-on. Users will be informed before any additional charges apply.
Mixing & Mastering as a Bonus Feature — Subject to Change
Mixing and Mastering, when included as part of an All-Access subscription plan, is provided as a bonus feature and is not a core component of the subscription. It is offered as an added value at Sessions Boutique's sole discretion and is subject to revision limits as communicated through the platform. Sessions Boutique reserves the right to modify, limit, suspend, or permanently discontinue the Mixing and/or Mastering feature at any time, with or without notice, and for any reason, including but not limited to changes in operational capacity, service scope, or business strategy. The removal or modification of this feature shall not constitute a material change to the subscription, shall not entitle Users to any refund, credit, or compensation, and shall not be considered a failure of the Services. Users who require guaranteed, unlimited, or professional-grade mixing and mastering services should consider the separately available paid add-on option.
5.2 Music Classes & Logic Pro Training as a Bonus Feature — Subject to Change
Sessions Boutique's All-Access subscription may include access to Music Classes and Logic Pro Training as a bonus feature. These sessions are facilitated by participating musicians and producers who have chosen to offer tutoring through the platform. Not all musicians or producers on the Sessions Boutique roster offer classes or training, and not all instruments, subjects, or software topics are available at any given time.
The availability of Music Classes and Logic Pro Training, including the instruments offered, the subjects covered, the software topics available, and the instructors providing sessions, may change at any time without notice. Sessions Boutique does not guarantee that any specific instrument, subject, software topic, or instructor will be continuously available.
Music Classes and Logic Pro Training, when available, are provided as a bonus feature and are not a core component of the All-Access subscription. Sessions Boutique reserves the right to modify, limit, suspend, or permanently discontinue Music Classes, Logic Pro Training, or any specific instrument, subject, software topic, or instructor within the program, at any time, with or without notice, and for any reason, including but not limited to changes in musician or producer availability, operational capacity, service scope, or business strategy.
The removal or modification of Music Classes, Logic Pro Training, or any component thereof shall not constitute a material change to the subscription, shall not entitle Users to any refund, credit, or compensation, and shall not be considered a failure of the Services.
5.3 Creative Credit and Professional Responsibility
Music Producers, Arrangers, Mixing Engineers, Mastering Engineers, and other creative professionals engaged through Sessions Boutique provide services based on their professional expertise, artistic judgment, and creative direction.
Users retain final creative control over their projects and may accept, reject, modify, or replace any recommendation, arrangement, production decision, mix, master, edit, or other creative contribution made during the course of the Services.
If a User substantially modifies, replaces, disregards, or materially alters the work, recommendations, or creative direction provided by a Sessions Boutique professional, that professional shall not be considered responsible for the resulting work or its artistic, technical, or commercial outcome.
Furthermore, the User shall not identify, credit, represent, advertise, or otherwise imply that any Producer, Arranger, Mixing Engineer, Mastering Engineer, or other Sessions Boutique professional created, approved, endorsed, or is professionally responsible for a final version of a project that has been materially modified without that professional's prior written consent.
Sessions Boutique reserves the right to require the correction or removal of any inaccurate, misleading, or false professional credit or attribution relating to Services performed through the platform.
5.4 Subscription Cancellation
You may cancel your subscription at any time through The Studio by navigating to the main dashboard and selecting Subscription & Billing, which will redirect you to our secure billing portal (currently powered by Stripe), where you can manage or cancel your subscription.
Cancellation becomes effective only after it has been successfully completed through the billing portal. Simply uninstalling the application, deleting your account, ceasing to use the Service, or contacting Support does not cancel your subscription.
If you experience technical issues preventing you from accessing the billing portal, you should contact Support as soon as reasonably possible before your renewal date.
Although we may, at our sole discretion, assist with subscription cancellations upon request, such assistance is provided solely as a courtesy and is not guaranteed. Support requests submitted through The Studio support channel, by email, or through any other communication channel do not constitute cancellation unless and until we confirm that the cancellation has been successfully processed.
You acknowledge that Support requests may not be reviewed or processed immediately, including outside normal business hours, on weekends, during holidays, or during periods of high support volume. Accordingly, you remain solely responsible for ensuring that your subscription is successfully canceled before your next renewal date and time. We are not responsible for subscription renewals or related charges resulting from cancellation requests that were not reviewed or processed before the applicable renewal because they had not yet been received, reviewed, or completed.
Cancellation of your subscription stops future automatic renewals only. Canceling your subscription before the end of your current subscription term does not entitle you to a full or partial refund, credit, or reimbursement for any unused portion of the subscription period, except where required by applicable law. You will continue to have access to the applicable subscription benefits until the expiration of your current paid subscription term.
You acknowledge that any messages, notifications, estimates, or information displayed by a payment processor or billing provider regarding refunds, credits, or billing adjustments do not modify these Terms or create any entitlement to a refund unless we expressly approve such refund in writing or unless required by applicable law.
5.5 Subscription Expiration and Content Access
If you cancel your subscription, you may continue using the Service until the end of your current subscription term. However, if you schedule a recording session near the expiration of your subscription, you acknowledge and agree to the following:
Musicians may take up to twenty-four (24) hours after a successful session to deliver recordings, edits, or other session-related files.
If your subscription expires before such files are delivered, you acknowledge that you are not entitled to access or receive those files after your subscription has expired.
Once your subscription has expired, you will no longer be able to request revisions, corrections, additional recordings, or follow-up sessions related to any prior session unless you maintain or renew an active subscription.
We may, at our sole discretion, permit a musician to deliver completed files after your subscription has expired. Any such delivery is a courtesy only, does not create any obligation or precedent, and may be made through the Project messaging system or another method we choose.
If we permit post-expiration delivery, you acknowledge that access to the Project, its messages, and any downloadable files may be available only for a limited period. We may delete Projects, messages, recordings, uploaded files, and other associated content at any time after your subscription expires, and we have no obligation to retain, archive, restore, or recover such content.
If your subscription expires due to cancellation, non-renewal, payment failure, or any other reason, your Projects, recordings, uploads, messages, and other associated content may be permanently deleted without further notice. You are solely responsible for downloading and preserving any content you wish to keep before your subscription expires.
5.6 Promotional Offers and Abuse
From time to time, we may offer promotional pricing, introductory discounts, coupon codes, or other special offers. Unless expressly stated otherwise, such offers are intended solely for first-time eligible subscribers and may be redeemed only once per individual, household, payment method, device, or other eligibility criteria that we determine in our sole discretion.
You agree not to create or use multiple accounts, multiple email addresses, alternative payment methods, aliases, devices, or any other method to obtain the same promotional offer more than once or otherwise circumvent the eligibility requirements of any promotion.
If we determine, in our sole discretion exercised reasonably, that a promotional offer has been obtained or used in violation of these Terms, we may, at any time and without limiting any other available rights or remedies:
- revoke the promotional discount or offer;
- charge the difference between the promotional price paid and the applicable standard subscription price;
- require payment of any outstanding balance within twenty-four (24) hours of notice;
- suspend or terminate the applicable account or subscription; and/or
- deny eligibility for future promotional offers.
Failure to pay any outstanding balance within the specified time may result in the suspension or termination of your account and access to the Service. Any suspension or termination under this Section shall not entitle you to any refund, credit, reimbursement, or other compensation, except where required by applicable law. Our failure to detect or act upon a violation immediately does not waive our right to investigate, enforce these Terms, or take action at a later time.
5.7 Referral, Affiliate, and Promotional Programs
From time to time, we may offer referral, affiliate, ambassador, partner, influencer, or other promotional programs (collectively, "Promotional Programs"). Participation in any Promotional Program is subject to these Terms and any additional terms, rules, or eligibility requirements that we may publish for the applicable program.
Unless expressly authorized by us, you may not refer yourself, create or use multiple accounts, use false identities, engage in fraudulent or deceptive conduct, use automated methods, or otherwise manipulate or abuse any Promotional Program to obtain rewards, commissions, discounts, credits, or other benefits.
We reserve the right, in our sole discretion exercised reasonably, to withhold, deny, reverse, adjust, or cancel any reward, commission, discount, credit, or other benefit if we determine that it was obtained through fraud, abuse, ineligible activity, violation of these Terms, chargebacks, refunded transactions, canceled subscriptions, or any other activity that compromises the integrity of the Promotional Program.
We may modify, suspend, or terminate any Promotional Program, or change its eligibility requirements, benefits, or rewards, at any time with or without notice, unless otherwise required by applicable law. Participation in a Promotional Program does not create any vested right to receive future rewards, commissions, discounts, credits, or continued participation.
Except where required by applicable law or expressly provided in the applicable Promotional Program, rewards, commissions, discounts, credits, and other promotional benefits have no cash value, are non-transferable, are not redeemable for cash, and are non-refundable.
6. Add-Ons and Additional Services
Orchestra Recording Services
(Currently available for bookings in Brazil)
Orchestra services require a minimum 10-day advance booking to ensure availability and proper preparation. Upon payment, your session is immediately confirmed.
Cancellation & Rescheduling Policy for Orchestra Services:
- 72+ hours before session: Full refund minus credit card processing fees
- Within 72 hours of session: No refund (100% retained)
- Rescheduling: One (1) free reschedule allowed if requested 7+ days before the scheduled session. Rescheduled date must be within 90 days of original booking.
Optional Add-On Services:
The following add-on services may be purchased in conjunction with orchestra bookings:
- 1. Original Composition — Custom music composed by our team. Full rights buyout included. Requires 30+ days advance booking. Non-refundable once composition work begins.
- 2. Scoring & Orchestration — Professional arrangement and notation services. Non-refundable once scoring work begins.
- 3. Video Shooting — Professional filming with fixed and moving cameras. Must be booked at time of orchestra session booking. Refundable up to 72 hours before session.
- 4. Video Editing — Post-production video editing. Non-refundable once editing work begins. Typical delivery: 7-14 business days.
- 5. Premium Mixing and Mastering — Professional audio post-production by in-house engineers. Non-refundable once mixing work begins. Typical delivery: 7-10 business days.
- 6. Music Production — Full production guidance from concept to final master. Non-refundable once production work begins.
All add-on services display rates and terms clearly at time of booking. All orchestra musicians and add-on service providers are independent contractors.
In the future, additional services may be introduced. If new services are activated, all terms and rates will be clearly displayed prior to booking.
7. Booking Policy and Availability
Users may book as many live sessions as they wish, subject to each Musician's or Provider's availability and the platform's scheduling capacity. The Studio operates a fair-access scheduling system designed to balance demand among Users and Musicians.
Sessions may be booked for:
- Your own solo projects
- Projects for your band or musical group in which you are a direct member
- Internal projects for a company or organization you represent
You may not resell, sublicense, or share your account, subscription, or booked sessions with third parties. Using The Studio to deliver or fulfill services for third parties outside your own projects is strictly prohibited and may result in suspension or termination without refund.
The Studio aims to provide consistent and fair access to live sessions for all actively booking subscribers. While we work to maximize overall availability, actual session access may vary depending on musician schedules, time zones, instrument demand, and overall platform activity. Session availability is not guaranteed and may fluctuate based on these operational considerations.
If, despite good-faith booking attempts, a User's completed sessions fall materially below typical platform availability in a given billing cycle, The Studio may, at its sole discretion, issue a non-cash service credit (e.g., priority booking token or an additional month of service). Credits have no cash value and may expire.
To qualify for such a credit, Users must:
- (i) submit complete session materials;
- (ii) offer at least three (3) reasonable time windows over two (2) different days;
- (iii) accept reassignment to other qualified Musicians or Providers when necessary; and
- (iv) have no cancellations or no-shows in that cycle.
Force majeure events, platform maintenance, and operational constraints are excluded.
If a Musician or Provider faces an emergency more than forty (40) hours before a scheduled session, the User may submit a change request. Emergencies within forty hours require mutual agreement between User and Musician via the in-app message system to avoid a no-show designation.
Users may cancel a confirmed session or submit a schedule change request up to forty (40) hours before the scheduled start time. Within forty (40) hours of a session's start time, the cancel and schedule change options are no longer available through the platform. Sessions Boutique does not guarantee that a musician will be able to accommodate last-minute changes once the forty-hour window has passed.
7.6 Booking Confirmations and Notifications
When you book a session, we may send booking confirmations, reminders, and other notifications by email, through The Studio, by push notification (if you have installed our mobile application and enabled notifications), or through other communication methods that we may make available.
These notifications are provided solely as a courtesy to assist you in managing your bookings. You acknowledge that the delivery of emails, push notifications, and other communications depends on third-party providers, your device settings, internet connectivity, spam filters, notification permissions, and other factors beyond our reasonable control. Accordingly, we do not guarantee that any confirmation, reminder, or notification will be sent, received, or delivered at any particular time.
You are solely responsible for monitoring your account, confirming your booking details, noting your scheduled session date and time, accounting for your local time zone, and joining your session at the scheduled time. The failure, delay, or non-delivery of any booking confirmation, reminder, or notification does not excuse your failure to attend a scheduled session and does not, by itself, entitle you to a refund, credit, rescheduled session, extension, or other compensation, except where required by applicable law.
7.1 Platform-Initiated Cancellations (Rare and Unforeseen Circumstances)
In rare cases, Sessions Boutique may need to cancel or reschedule a session due to unforeseen operational issues, system outages, emergency maintenance, or unexpected Musician unavailability.
If Sessions Boutique cancels a scheduled session, Users will be offered one of the following, at Sessions Boutique’s discretion:
- Re-booking the session with the same Musician at the next available time;
- Assignment of a replacement Musician with comparable skills and experience; or
- Rescheduling of the session to a mutually available future time slot.
Sessions Boutique is not obligated to provide monetary refunds, service credits, or other compensation in connection with such cancellations, except where required by applicable law.
7.2 Free Credits, Promotional Credits, and Trial Credits
The Studio may issue free credits for limited use. These are subject to the following:
Booking Scope: Booking Scope: Free credits may be used to book a session with any available Musician or Provider.
Trial Session Duration: Trial Session Duration: Free trial sessions are limited to 30 minutes, allowing Users to evaluate the service. Regular subscription sessions are 60 minutes.
Trial Session Deliverables: Trial Session Deliverables: Users will receive the final audio files from a free trial session, but downloading the recordings requires an active subscription plan.
No Cancellations Allowed: No Cancellations Allowed: Sessions booked using free credits cannot be canceled. Any cancellation attempt results in forfeiture of the credit.
Missed Sessions / No-Shows: Missed Sessions / No-Shows: If the User does not attend a scheduled free trial session, the free trial credit will be forfeited and will not be reissued. Each User is eligible for only one free trial credit, and missed trial sessions are not eligible for rescheduling or replacement.
Expiration: Expiration: Free credits may expire and will not be reinstated after expiration.
Non-Transferable / No Cash Value: Non-Transferable / No Cash Value: Free credits cannot be sold, transferred, or converted into monetary value or subscription payments.
Platform-Initiated Cancellations: Platform-Initiated Cancellations: If The Studio cancels a free-credit session, the User may re-book with the same Musician or a replacement. The credit will not be lost.
Free credits do not count toward availability targets and do not qualify for service credits.
7.3 Session Start Time & 15-Minute Grace Period
To respect the time and availability of our musicians and maintain fairness for all Users, sessions begin promptly at the scheduled start time.
A grace period of fifteen (15) minutes is provided in the event a User is late. If the User does not join the session within the first fifteen (15) minutes (e.g., for a 2:00 PM session, by 2:15 PM), the session will be considered a "no-show," automatically marked as completed, and the musician will no longer be required to remain available.
Although the User may technically retain access to the session room for the remainder of the scheduled time slot, the musician will not be obligated to rejoin or extend the session beyond the 15-minute grace period.
For paid sessions, the session will be considered used, and the User may book a new session in accordance with their subscription terms.
For free trial sessions, the credit will be permanently forfeited and will not be replaced.
This policy ensures fairness and sustainability for both musicians and Users, as it would not be reasonable to require musicians to remain on standby beyond the designated grace period.
7.4 Concurrent Booking Limit
To maintain fair access and sustainable scheduling for all Users, while subscriptions may allow unlimited sessions over time, Users may not hold more than four (4) upcoming or uncompleted sessions at any given time.
If a User has four (4) scheduled sessions that have not yet been attended or completed, the User must complete at least one of those sessions before booking additional sessions.
Once a scheduled session has been completed (or marked as completed), the User may book another session, maintaining a maximum of four (4) active future bookings at any time.
This policy helps ensure balanced availability across the platform and equitable access for all members.
7.5 Subscription Status and Scheduled Sessions
Access to Sessions Boutique’s Services, including the ability to participate in live recording sessions, is conditional upon maintaining an active and valid subscription at the time the session is scheduled to occur.
If a User cancels or does not renew their subscription, any previously scheduled sessions that occur after the subscription end date may be automatically cancelled by Sessions Boutique.
In such cases, Sessions Boutique is not obligated to provide the scheduled session unless otherwise required by law or explicitly stated in a separate agreement or promotion. Where applicable, Sessions Boutique may, at its sole discretion, offer rescheduling options, credits, or alternative arrangements, but is not required to do so.
Users are responsible for ensuring that their subscription remains active if they intend to use booked sessions scheduled for future dates.
8. No Refunds for Completed or Missed Live Sessions
All sessions are live and interactive, similar to in-studio experiences.
Refunds are not available once a subscription becomes active, including for completed, missed, or partially attended sessions.
An exception may apply if the User has not booked any session during the current billing cycle and submits a refund request before the cycle ends. Refunds, when granted, are at The Studio's sole discretion and may be reduced by transaction fees.
8.1 Refunds and License Termination
Any refund issued by Sessions Boutique automatically terminates the User's license to use any recordings, performances, stems, multitracks, or other content associated with the refunded Services. Following a refund, the User may not use, distribute, publish, monetize, publicly perform, or otherwise exploit such content in any manner.
9. Communication and Conduct
All Users, Musicians, and Providers must maintain professionalism and respect.
Harassment, discrimination, hate speech, or misconduct may result in suspension or termination.
9.1 Platform Communication and No Circumvention
All communication between Users and Musicians related to Sessions Boutique sessions, including but not limited to scheduling, recording instructions, technical coordination, and performance-related discussions, must occur exclusively through the Sessions Boutique platform and its designated communication tools.
Users and Musicians are strictly prohibited from exchanging or requesting personal contact information, including but not limited to telephone numbers, WhatsApp, email addresses, social media handles, or any other off-platform contact details for the purpose of communicating outside the Sessions Boutique platform.
This restriction applies during and after any session, including completed, canceled, or refunded sessions.
In the event of technical issues affecting live audio or streaming features, Users and Musicians are required to continue communication through the Sessions Boutique messaging system or other platform-provided tools. Sessions Boutique may provide alternative in-platform communication methods if necessary to ensure session continuity.
Any attempt to circumvent the platform’s communication systems may be considered a material breach of these Terms and may result in immediate suspension or termination of access to the Services, without entitlement to refunds or compensation.
Add-on to Communication and Circumvention of Platform — Musicians
Unless expressly approved by Sessions Boutique in writing, Musicians acknowledge and agree that any violation of this communication and anti-circumvention policy, including but not limited to exchanging, requesting, or attempting to exchange personal contact information with Users (such as phone numbers, WhatsApp, email addresses, social media handles, or any other off-platform contact details) for the purpose of conducting, continuing, or redirecting Services outside the Sessions Boutique platform, constitutes a material breach of their agreement with Sessions Boutique. Such violations may result in immediate suspension or termination of the Musician’s access to the platform, forfeiture of unpaid or future earnings associated with the Services, and termination of the applicable musician agreement, in addition to any other rights or remedies available to Sessions Boutique under that agreement or applicable law.
9.2 Messaging System — Permitted Use and Limitations
The Sessions Boutique messaging system is a communication tool provided to facilitate session coordination and project management between Users, Musicians, and Providers. It is not a substitute for booked sessions and may not be used to obtain creative work, performances, production services, or any other service that would ordinarily require a scheduled session.
Permitted Uses
- Coordinating session scheduling, availability, and logistics.
- Sharing reference tracks, files, or technical instructions in preparation for a booked session.
- Asking clarifying questions about the scope, direction, or requirements of a project.
- Following up on deliverables or file delivery after a completed session.
- Communicating with a Musician or Provider during an active booked session when technical issues affect the live session room, in order to maintain session continuity.
Prohibited Uses
- Requesting a Musician or Provider to perform, record, produce, arrange, mix, master, or otherwise work on any aspect of a project outside of a formally booked and paid session.
- Using the messaging thread as a substitute for a session — for example, requesting written feedback, chord charts, arrangement notes, or production guidance that goes beyond basic coordination.
- Pressuring, repeatedly asking, or implying that a Musician or Provider should contribute creative or professional work through messages in exchange for a future booking or a positive review.
- Requesting, sharing, or soliciting personal contact information of any kind — including phone numbers, WhatsApp, email addresses, or social media handles — for any purpose. All communication must remain within the platform. See §9.1 for full details.
- Using messaging to negotiate or arrange work to be performed outside the platform, which is separately prohibited under §9.1 of these Terms.
Musicians and Providers are not obligated to respond to messages requesting creative work outside of a booked session. Sessions Boutique does not guarantee response times to messages and is not liable for any outcome related to a Musician's or Provider's choice not to respond to out-of-scope requests.
Violation of this policy — including repeated, persistent, or willful misuse of the messaging system — shall be considered a breach of these Terms and may result in a warning, temporary suspension, or permanent termination of the User's account, at Sessions Boutique's sole discretion, without entitlement to refunds.
10. Independent Contractors
Orchestra musicians provided through add-on services are independent contractors, not employees or agents of Sessions Boutique.
They are responsible for their own taxes, licenses, and legal obligations.
11. Ownership and Intellectual Property
- All platform materials (text, code, graphics, trademarks, and branding) belong to Sessions Boutique.
- Users retain ownership of any original content or recordings they upload, subject to the licenses granted for processing and delivery.
- Musicians participating in The Studio waive all rights in favor of the User for any audio recordings created through the app.
- Sessions Boutique holds full written authorization from each participating Musician to grant such waivers universally and perpetually.
- Recordings delivered through The Studio are cleared for synchronization with images (e.g., film, video, games) worldwide and perpetually, without the need for additional fees.
- Musicians may reference their participation in portfolios or credits unless a written confidentiality agreement states otherwise.
- For film, television, or media productions, The Studio by Sessions Boutique must be credited according to industry standards.
12. User Responsibilities
You agree not to:
- Misuse the app or violate any law
- Record or distribute a session without consent from all participants
- Share your login credentials or allow others to access your account
- Book an unreasonable number of sessions for repetitive or revision-based work
- Advertise The Studio or its Musicians as part of your own service without permission
- Interfere with platform security or impersonate another person
Repeated misuse may result in termination, suspension, and/or legal action.
13. Technical Requirements
Users must meet minimum technical standards:
- 8 Mbps down / 4 Mbps up internet
- Wired or strong Wi-Fi connection
- Desktop/laptop recommended
- Updated browser
- Headphones required
The Studio is not responsible for issues caused by poor equipment or unstable connections.
13.1 Recording Standards and Tempo Requirements
To enable accurate professional recordings, Users are responsible for providing all technical information reasonably necessary to complete the requested work.
When submitting a project that requires synchronization with existing audio, Users must provide a consistent and identifiable tempo (BPM), click track, or other timing reference whenever applicable.
Certain AI-generated recordings, improvised performances, or edited audio files may contain inconsistent or fluctuating tempos that cannot be accurately synchronized without substantial additional editing or reconstruction. In such cases, Sessions Boutique may determine that the project cannot be completed as submitted.
Sessions Boutique and its musicians are not required to perform recordings without a reliable timing reference solely because a User intends to manually edit or align the recordings afterward. Our musicians record to professional production standards, and projects must meet the minimum technical requirements necessary to produce accurate and reliable performances.
If a project cannot reasonably be completed due to missing, inconsistent, or inadequate timing information, Sessions Boutique may request additional materials, require project revisions, decline the recording request, or cancel the session in accordance with these Terms.
13.2 Live Streaming and Connectivity
Real-Time Streaming
Sessions Boutique provides real-time audio streaming over the Internet. While we strive to provide a reliable and uninterrupted experience, real-time audio performance depends on numerous factors outside Sessions Boutique's reasonable control, including without limitation, the User's Internet connection, Wi-Fi quality, mobile hotspot or shared network performance, VPNs, firewalls, browser settings, browser extensions, operating system behavior, device performance, Internet service providers, network congestion, and other third-party hardware, software, or network conditions. Accordingly, Sessions Boutique does not guarantee uninterrupted, continuous, error-free, or latency-free live streaming during any session.
User Responsibility
Users are responsible for ensuring that they have a stable and suitable Internet connection, a supported web browser, compatible hardware, and an environment appropriate for participating in live recording sessions. If technical issues arise due to the User's equipment, browser, network configuration, Internet connection, VPN, firewall, shared network, corporate network restrictions, browser extensions, or other conditions outside Sessions Boutique's control, such issues shall not constitute a failure of the Services.
Browser and Network Behavior
Because Sessions Boutique delivers live audio through standard web technologies, browser behavior may vary depending on device settings, browser optimization features, operating system resource management, security software, background tab limitations, power-saving modes, or network conditions. Users acknowledge that browser- or network-related interruptions, delayed connections, reconnects, temporary audio loss, or similar events may occur even when Sessions Boutique's systems and the musician's connection are operating normally.
Recording Priority
If live audio and/or video streaming becomes unavailable during a session for any reason, Sessions Boutique may continue the recording process without uninterrupted live monitoring, provided that the recording can reasonably continue. In such cases, the assigned Musician may complete the requested recording independently, and the resulting audio recordings shall be delivered to the User through the Sessions Boutique platform in the same manner as recordings completed during a fully connected live session. The primary purpose of Sessions Boutique is to facilitate the creation and delivery of professional audio recordings. Accordingly, Sessions Boutique prioritizes the integrity and quality of the recording process over ancillary real-time streaming features, including live audio and video monitoring. Users acknowledge that live streaming functionality is provided to facilitate collaboration during sessions and may occasionally experience interruptions, delays, reduced quality, temporary unavailability, or reconnections without affecting the recording process itself. Such interruptions or degradation of live streaming, standing alone, shall not constitute a material failure of the Services and shall not entitle the User to a refund, credit, or other compensation, provided that the recording Services were substantially performed.
No Liability for Third-Party Networks
Sessions Boutique is not responsible for interruptions, delays, degraded performance, packet loss, latency, connection failures, or other issues resulting from Internet service providers, local networks, shared or public Wi-Fi, corporate or institutional networks, mobile carriers, cloud providers, browser vendors, operating system vendors, or other third-party services or infrastructure.
Technical Support and Diagnostics
Sessions Boutique may review technical logs and diagnostic information to investigate reported connectivity or streaming issues. Such logs may be used to determine whether an issue originated from Sessions Boutique's infrastructure or from factors outside its reasonable control.
User Cooperation During Technical Issues
Users agree to reasonably cooperate with troubleshooting efforts during a live session, including refreshing the browser, reconnecting to the session, disabling VPNs, switching networks when reasonably possible, or following other technical instructions provided by Sessions Boutique or the assigned musician. A User's refusal to follow reasonable troubleshooting instructions may limit Sessions Boutique's ability to resolve technical issues and shall not constitute a failure of the Services.
13.3 AI Interpreter and Translation Services
Sessions Boutique may provide AI-based interpretation or translation features to facilitate communication between Users and musicians during sessions, support interactions, and service-related communications.
These AI tools are provided for convenience only and may contain errors, omissions, delays, or contextual inaccuracies. Sessions Boutique does not guarantee that AI-generated interpretation or translation will be exact, complete, culturally nuanced, or legally accurate.
Users remain solely responsible for confirming all essential session instructions, technical directions, legal terms, deliverable details, and business decisions in a language they fully understand before relying on any statement or proceeding with any project-related action.
To the maximum extent permitted by law, Sessions Boutique disclaims liability for misunderstandings, losses, delays, technical mistakes, or disputes resulting in whole or in part from AI-generated interpretation or translation, including any reliance placed on such output by Users or third parties.
Sessions Boutique may modify, suspend, or discontinue AI interpretation or translation features at any time without prior notice. Continued use of the Services after such changes constitutes acceptance of the updated functionality and these Terms.
14. Recording Non-Original Material (Covers, Versions, Arrangements)
- Users may record non-original material ("covers," "versions," or "arrangements") using The Studio.
- However, all copyright compliance is the User's sole responsibility.
- Users warrant that they hold or have obtained necessary rights, licenses, or permissions for such use.
- The Studio and its Musicians disclaim any liability for copyright disputes.
- Users agree to indemnify and hold harmless Sessions Boutique and all Musicians against any claims arising from unauthorized recordings.
15. Deliverables
All deliverables are transmitted through the platform.
Large files may be exchanged through approved secure methods when necessary.
Musicians deliver clean, high-quality audio recordings.
Mixing and Mastering are included with the All-Access subscription for standard projects. Complex projects may require a separately quoted add-on service, as described in Section 5.1.
Users are responsible for final production and release preparation.
15.1 Audio Retention
Sessions Boutique may automatically delete uploaded or generated audio files, recordings, stems, session files, messages containing audio, or other media after thirty (30) days.
Users are solely responsible for downloading and securely storing any recordings or other content they wish to retain. Sessions Boutique is under no obligation to preserve, archive, recover, or restore files after they have been deleted.
If you cancel your subscription, you acknowledge that your access to audio files, recordings, uploads, and other content associated with your account may be restricted or terminated at the end of your subscription period. Following the expiration or termination of your subscription, we may permanently delete such content from our systems at any time and are under no obligation to retain, archive, or recover it.
You are solely responsible for downloading or otherwise preserving any content you wish to keep before your subscription expires or is terminated.
15.2 Project Scope and Deliverables
Each Project created on Sessions Boutique represents one distinct musical work to be recorded through the platform within a single session or across multiple sessions, as applicable.
A "Project" refers to one distinct song or defined musical composition submitted by the User through the Sessions Boutique platform and allocated by Sessions Boutique to an available musician for performance and recording.
Users may not use a single Project to request, bundle, or include multiple separate songs, compositions, or unrelated musical works within the same Project scope, whether provided as separate reference tracks, a combined audio file, or a continuous recording containing multiple distinct pieces.
If submitted materials include multiple songs or clearly separate compositions, Sessions Boutique may, in its sole discretion, (i) require the User to split the material into separate Projects, (ii) treat the submission as multiple Projects requiring additional bookings, or (iii) decline the request if it does not conform to Project scope requirements.
Medleys, suites, or intentionally continuous compositions that constitute a single unified artistic work may be treated as a single Project when clearly indicated by the User and accepted by the assigned musician(s) or determined appropriate by Sessions Boutique.
Sessions Boutique reserves the right to determine, in good faith, whether submitted material constitutes one Project or multiple Projects based on musical structure, artistic intent, and production requirements.
15.3 Audio Delivery Timeline
Sessions Boutique targets delivery of final audio files within 24 hours after a session in which recording was successfully captured. While files are often uploaded by the musician immediately following a session, this 24-hour window is an expected timeframe and not a guaranteed contractual deadline.
Sessions Boutique does not guarantee delivery within any specific timeframe. Delivery may be delayed or require coordination beyond the standard window in cases including, without limitation: the session was incomplete or cut short; additional recording passes are required to finish the piece; technical issues occurred during or after the session; the musician requires additional time to export or review the files; or other circumstances outside Sessions Boutique's reasonable control.
If a session did not result in a complete, usable recording — whether due to time constraints, technical issues, scope of the piece, or other factors — the musician will coordinate directly with the User through the project thread regarding next steps, additional sessions, or revised delivery timelines. Such circumstances shall not automatically entitle the User to a refund, credit, or re-booking at no charge.
Sessions Boutique is not liable for any losses, costs, project delays, or damages arising from delayed audio delivery, provided that Sessions Boutique and its musicians acted in reasonable good faith to complete and deliver the recording.
15.4 MIDI Files
MIDI files are not provided as part of any service offered through the Platform.
The standard deliverable for keyboard, piano, and other MIDI-capable instrument recording sessions is the rendered audio recording only. Users are not entitled to receive MIDI files generated or used during a session, and Musicians are not permitted to provide MIDI files to Users through or in connection with the Platform.
Any request for MIDI files will be declined in accordance with this policy.
15.5 Audio File Delivery
The standard deliverables for recording sessions are audio files in one or more of the following supported formats, as applicable to the service provided: WAV, MP3, OGG, FLAC, AAC, M4A, AIFF, WebM, and Opus.
Individual files delivered through the Platform may not exceed 1 GB in size. If a deliverable exceeds this limit, it will be provided through a secure downloadable link within the applicable Project page instead of a direct file upload.
Session files or other production project files (such as Pro Tools sessions) are not standard deliverables and may only be provided at the Musician's sole discretion, if applicable. When such files are provided and exceed the Platform's file size limit, they will be delivered through a secure downloadable link within the applicable Project page.
Sessions Boutique reserves the right to determine the appropriate delivery format and method based on the nature of the service, file size, technical requirements, and Platform limitations.
16. Account Security and Confidentiality
You are responsible for maintaining the confidentiality of your account credentials.
Notify us immediately of any unauthorized use.
You are liable for all activity under your account.
16.1 Account Integrity and Fraud Prevention — One Account Policy
Users are permitted to maintain only one active account on Sessions Boutique. Creating, using, or attempting to use multiple accounts, whether with different email addresses, identities, payment methods, or other means, is strictly prohibited.
This includes, without limitation, creating duplicate or alternate accounts for the purpose of obtaining promotional credits, free sessions, referral benefits, or other incentives more than once.
Sessions Boutique employs automated systems and manual review processes to detect fraudulent, abusive, or duplicate account activity. Any violation of this policy may result in immediate suspension or termination of all associated accounts without prior notice, and Sessions Boutique reserves the right to revoke access to Services, credits, recordings, or benefits obtained through such activity.
Such violations may also result in the forfeiture of any unpaid or unearned Services, and may disqualify the User from future use of the platform.
17. Termination
We may suspend or terminate accounts that violate these Terms or disrupt the platform.
Users may cancel subscriptions or delete their accounts at any time via account settings.
18. Refund Policy
All subscription fees are charged in advance and are non-refundable once a billing cycle has begun, except where required by applicable law. By subscribing, you acknowledge and agree that you will not be entitled to a refund for any unused portion of a subscription period after it has started.
Sessions Boutique does not issue refunds for: completed sessions; missed sessions due to User no-show, late arrival, or cancellation within the 40-hour window; sessions where the User experienced technical difficulties attributable to their own equipment, internet connection, browser, VPN, or network; sessions that ran for their full scheduled duration regardless of whether the User's creative goals were fully achieved; or subscription fees for months in which the User did not use the platform.
Refunds may be considered at Sessions Boutique's sole discretion in the following limited circumstances: (i) a session was cancelled by Sessions Boutique or the assigned musician with no replacement or credit offered; or (ii) a verified, material platform failure prevented the session from occurring entirely and was confirmed by Sessions Boutique's technical team. Such refund requests must be submitted within 7 days of the session date.
Refunds, when granted, automatically terminate the User's license to use any recordings, stems, or content associated with the refunded session, as further described in the License Termination clause above.
For subscriptions canceled before renewal: cancellation takes effect at the end of the current billing period. You retain full access until that date. No prorated refunds are issued for mid-cycle cancellations.
19. Fair Use and Session Limits
Sessions Boutique's subscription model is designed to give individual artists, producers, and creators unlimited access to professional recording sessions for their own music projects. "Unlimited" sessions means there is no hard cap on the number of sessions you may book per month, subject to musician availability and reasonable use.
Sessions Boutique reserves the right to investigate and restrict accounts that display patterns of abuse, including without limitation: booking sessions at a volume inconsistent with individual creative use; booking sessions for the purpose of reselling, sublicensing, or fulfilling services for third-party clients; using a single subscription to serve multiple artists, bands, or commercial entities simultaneously; booking sessions with the intent to extract or stockpile recordings for commercial exploitation beyond the scope of a single original project.
Sessions Boutique may, in its sole discretion, limit session frequency, require account review, suspend access, or terminate accounts found to be in violation of fair use principles without refund. Users who have legitimate high-volume needs (such as labels or production companies) should contact Sessions Boutique to discuss appropriate arrangements.
20. Musician No-Show, Unavailability, and Departure from Platform
In the rare event that a confirmed musician fails to appear for a scheduled session without prior notice, Sessions Boutique's sole obligation is to offer the User one of the following remedies: (i) rescheduling the session with the same musician at a mutually agreed time; or (ii) rescheduling with an equivalent replacement musician. For Users on free trial credits, a replacement credit may be offered at Sessions Boutique's discretion.
Sessions Boutique does not guarantee that the same musician will always be available to complete a project across multiple sessions. Musician availability is subject to scheduling, health, and personal circumstances. If a musician becomes unavailable mid-project, Sessions Boutique will make reasonable efforts to provide a qualified replacement.
A musician no-show or unavailability does not automatically entitle the User to a cash refund of subscription fees. The remedies described in this section represent the full extent of Sessions Boutique's liability in such circumstances.
Sessions Boutique does not guarantee the continued presence of any specific musician, producer, or creative professional on its platform. Musicians and other service providers may voluntarily leave the platform or be removed by Sessions Boutique at any time and for any reason, with or without prior notice. Sessions Boutique reserves the right to add, suspend, or permanently remove any musician from its roster at its sole and absolute discretion. In the event that a musician departs from the platform — whether before or after a session has been booked — Sessions Boutique's sole obligation is to make reasonable efforts to offer the User a rescheduled session with a qualified replacement. A musician's departure from the platform, for any reason, shall not constitute a material failure of the Services, shall not entitle the User to a refund, credit, or compensation of any kind, and shall not affect the User's ongoing subscription obligations. Users are advised not to make binding commitments or representations to third parties based on the assumed future availability of any specific musician on the Sessions Boutique platform.
21. Force Majeure
Sessions Boutique shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including without limitation: acts of God; natural disasters; pandemics or public health emergencies; war, terrorism, or civil unrest; government actions, laws, or regulations; power outages or failures of third-party infrastructure; Internet service provider outages; cyberattacks or data breaches affecting third-party systems; strikes or labor disputes; or any other event that could not have been reasonably foreseen or prevented.
In the event of a force majeure occurrence, Sessions Boutique will notify Users as soon as reasonably practicable and will make reasonable efforts to resume normal operations. During a force majeure period, affected sessions will be rescheduled or credited where reasonably possible. Sessions Boutique shall not be obligated to issue cash refunds solely on the basis of service disruption caused by a force majeure event.
22. Right of Denial and Prohibited Content
Musicians and The Studio reserve the right to decline participation in any project that violates our ethical or content standards.
This includes, but is not limited to, material containing:
- Pornographic or sexually explicit content
- Hate speech, racist, sexist, or xenophobic messages
- Discriminatory, violent, or oppressive themes
- Any content promoting illegal or harmful activity
Users attempting to request or produce such content may have their account immediately suspended without refund.
23. Limitation of Liability
To the maximum extent permitted by law, Sessions Boutique shall not be liable for indirect, incidental, or consequential damages resulting from your use of The Studio.
Total liability shall not exceed the total amount paid by you to Sessions Boutique during the 12 months preceding the claim.
24. Governing Law
These Terms are governed by and construed under the laws of the State of Florida, United States of America. By using The Studio, you agree that any dispute shall be brought exclusively in the courts located in Tampa, Florida, USA.
25. Dispute Resolution
Disputes will first be addressed through informal negotiation.
Unresolved matters will go to binding arbitration in Tampa, Florida.
26. AI-Generated Content Policy
26.1 Eligibility and Access
The AI Music Tool is included for Users subscribed to our All Access Plan. Non-subscribed Users may purchase access to the AI Music Tool on an individual (à la carte) basis. However, purchasing standalone access does not grant commercial usage rights as outlined below.
26.2 Purpose of the AI Music Tool
The AI Music Tool is provided as a creative assistance feature intended for idea development, experimentation, and personal use. It is not intended to serve as a final commercial production.
26.3 Personal Use License
Users may download and use AI-generated recordings for personal, non-commercial purposes only. Personal use includes private listening, internal demos, and non-monetized sharing.
This applies to:
- All Access Plan subscribers who have not used human production services for the AI-generated material
- À la carte purchasers of the AI Music Tool
26.4 Commercial Use Restriction
AI-generated recordings downloaded directly from the platform, without additional human production services provided by our musicians or producers, may not be used for:
- Commercial distribution
- Streaming platform releases
- Public monetization
- Synchronization licensing
- Sale, resale, or sublicensing
Standalone AI-generated recordings are licensed strictly for non-commercial use.
26.5 Commercial Rights Through Subscription and Human Production
Full commercial rights may be granted only when:
- The User is subscribed to the All Access Plan
- The AI-generated material is substantially developed, re-recorded, arranged, produced, or enhanced by our human musicians and/or producers
Upon completion of such services, the final produced recording may be commercially released and monetized, and full commercial rights in that final version belong to the User, subject to the applicable service agreement.
26.6 No Guarantee of Exclusivity for Raw AI Output
AI-generated recordings provided without human production services are non-exclusive and may not be claimed as fully original master recordings for commercial exploitation.
26.7 AI Tools as a Bonus Feature — No Guarantee of Output Quality
The AI Tools included as part of the All-Access subscription are provided as a bonus feature and are not a core component of the subscription. They are offered as added value at Sessions Boutique's sole discretion. Sessions Boutique makes no representations, warranties, or guarantees regarding the quality, accuracy, fitness for purpose, or suitability of any AI-generated output. AI-generated results are inherently variable and subjective — outputs may differ between requests, and results from one prompt may not be reproducible or consistent with a User's specific expectations. Sessions Boutique is not liable for any dissatisfaction with AI-generated outputs, regardless of the number of credits consumed, prompts submitted, or iterations attempted. Consumed credits — whether included in an All-Access subscription or purchased as standalone credit packs — are non-refundable once used, including in cases where the User is unsatisfied with the result. Sessions Boutique reserves the right to modify, limit, suspend, or permanently discontinue any AI Tool or feature at any time, with or without notice, and for any reason, including but not limited to changes in underlying technology, third-party licensing, operational capacity, or business strategy. The modification or removal of an AI Tool shall not constitute a material change to the subscription, shall not entitle Users to any refund, credit, or compensation, and shall not be considered a failure of the Services. Users who require guaranteed or specific AI output quality should consider alternative specialized AI services.
27. Recording AI-Generated Songs — Mandatory Production Triage
Sessions Boutique offers Users the ability to have AI-generated songs recorded by professional human musicians. Submitting an AI-generated song for recording is subject to the requirements set forth in this section, which are mandatory and non-negotiable.
27.1 Mandatory Production Triage
All AI-generated songs submitted for recording by a musician must first undergo a mandatory Production Triage session with a qualified Sessions Boutique Music Producer. This requirement applies to all Users without exception, regardless of the User's level of production experience, technical knowledge, or claimed familiarity with music production workflows.
AI-generated audio inherently lacks a stable, consistent tempo (BPM) and the properly structured session environment necessary for live musician recording. Even when an AI-generated song sounds complete and polished to the listener, its timing map is typically unsuitable for synchronous musician recording and will result in unusable recordings if this preparation step is bypassed.
The mandatory Production Triage session allows a qualified Music Producer to: analyze the AI-generated source material; establish a stable tempo map and click track; create a proper DAW session file suitable for live recording; and, where necessary, record a guide instrument to provide harmonic and rhythmic reference.
Sessions Boutique reserves the right to decline, postpone, or cancel any musician recording session submitted with AI-generated source material that has not been processed through the mandatory Production Triage step. No refund, credit, or compensation shall be owed to the User if a session is declined or cancelled solely because this mandatory requirement was not met.
27.2 No Right to Bypass the Production Triage Requirement
A User's self-identified status as a music producer, audio engineer, or other music professional does not exempt that User from the mandatory Production Triage requirement. Sessions Boutique, in its sole discretion, determines whether a submitted project has met the minimum technical requirements for live musician recording. A User who believes their AI-generated material does not require triage must obtain express written confirmation from Sessions Boutique prior to scheduling a musician recording session.
27.3 Limitations of Human Reproduction of AI-Generated Content
Our musicians will faithfully reproduce an AI-generated song to the greatest extent that is musically and physically possible for a human performer. However, AI-generated music may contain passages, note sequences, articulations, or performance instructions that are physically or technically impossible for a human musician to replicate.
Examples of content that may not be reproducible by a human musician include, without limitation: note ranges or fingerings beyond the physical limits of an instrument; passages requiring more simultaneous actions than a single musician's anatomy allows; tempos or articulations beyond the physical capability of any human performer; or sounds and timbres that cannot be produced by the acoustic or physical instrument in question.
In such cases, the assigned musician will, at their professional discretion, create the closest reasonably achievable professional performance that preserves the musical intent of the User's submission. Sessions Boutique and its musicians are not responsible for, and shall not be required to reproduce, any element of an AI-generated song that is physically, technically, or musically impossible for a human performer. Such cases shall not constitute a failure of the Services and shall not entitle the User to a refund, credit, or other compensation.
27.4 Multiple Sessions and Layered Recording
Professional recording of AI-generated songs typically requires multiple separate recording sessions. Recordings are built layer by layer — beginning with rhythm instruments and progressing through harmonic, melodic, and vocal elements. Each layer constitutes a separate booking. Users are responsible for planning and scheduling sessions in the appropriate sequence. Sessions Boutique is not responsible for delays arising from a User's failure to schedule sessions in a technically appropriate order.
28. Artistic Performance and AI-Generated References
28.1 Artistic Interpretation; No Exact Replication
Sessions Boutique's musicians provide professional musical performances based on their artistic judgment, technical expertise, and creative interpretation.
While Users may provide reference recordings, demos, AI-generated music, MIDI files, or other materials, Sessions Boutique does not guarantee that any performance will be an exact replication, clone, or identical recreation of any reference material.
By using the Services, You acknowledge and agree that our musicians deliver original performances that naturally include human interpretation, musical feel, dynamics, timing, groove, articulation, tone, and other artistic elements. Minor variations from any reference recording are expected and are not considered defects, errors, or grounds for refunds or disputes.
Sessions Boutique's Services are intended to provide performances by professional musicians—not automated or robotic reproductions of existing recordings or AI-generated content.
28.2 Sheet Music, Notation, and Sight-Reading
Users may provide sheet music, chord charts, lead sheets, tablature, or other written musical materials to assist the recording process.
However, Sessions Boutique does not guarantee that every musician offers sight-reading or real-time notation reading services. A musician's ability or willingness to perform directly from written notation may vary depending on the individual musician, instrument, musical style, complexity of the material, and session objectives.
Unless expressly agreed otherwise, musicians may perform using their preferred professional workflow, which may include listening by ear, using reference recordings, chord charts, written notation, or a combination of these methods.
Requests requiring advanced sight-reading, orchestral notation, or other specialized notation services should be communicated before the session. Sessions Boutique cannot guarantee that every musician is available or suitable for such requests.
28.3 Musical Style and Genre Authenticity
Sessions Boutique provides access to highly skilled professional musicians with diverse musical backgrounds and areas of expertise. However, music performance is inherently artistic, cultural, and stylistic.
Certain musical genres, regional traditions, cultural styles, or highly specialized performance practices may require unique techniques, phrasing, articulation, rhythmic interpretation, ornamentation, or stylistic conventions developed through extensive experience within those traditions.
While our musicians strive to perform each project professionally and accurately, Sessions Boutique does not guarantee that any performance will precisely replicate the stylistic nuances or regional authenticity associated with every musical tradition or cultural genre.
Users seeking highly specialized performances are encouraged to communicate their stylistic expectations before booking. Sessions Boutique may recommend a musician whose experience is better aligned with the requested style when reasonably possible.
Differences in artistic interpretation or stylistic approach that remain consistent with professional performance standards shall not be considered defects or grounds for refunds.
29. AI Training Restriction
No AI Training or Machine Learning Use
Unless expressly authorized in writing by Sessions Boutique, Users may not use, nor permit any third party to use, any recordings, performances, stems, multitracks, session audio, voice recordings, communications, or other content created or made available through the Services for the purpose of training, fine-tuning, developing, evaluating, or improving any artificial intelligence, machine learning model, large language model, voice synthesis system, music generation system, or similar automated technology.
This restriction applies regardless of whether the content is used directly or indirectly, in whole or in part, or in combination with other data.
Any unauthorized use of content for AI or machine learning purposes constitutes a material violation of these Terms.
30. Session Recording and Promotional Use
30.1 Sessions Boutique’s Right to Record
Sessions Boutique may record live sessions conducted on the Platform for purposes including quality assurance, safety monitoring, dispute resolution, technical support, and internal training. By using the Platform and participating in any live session, Users, Musicians, and Providers consent to such recording.
30.2 Promotional Use and Opt-Out
Sessions Boutique may also use session recordings, clips, or excerpts for promotional and marketing purposes, including but not limited to social media, website content, advertisements, and press materials. If you do not wish for your session to be used for promotional purposes, you may opt out at any time by submitting a written request to info@sessionsboutique.com. Your opt-out will apply to future promotional use only; content already published prior to your request will not be retroactively removed unless otherwise required by applicable law.
Opting out of promotional use does not affect Sessions Boutique’s right to record sessions for quality assurance, safety, and dispute resolution purposes.
30.3 Users May Not Record Sessions
Users are strictly prohibited from recording, capturing, or otherwise saving any portion of a live session by any means, including but not limited to screen recording software, third-party capture tools, external recording devices, or any other method. This prohibition applies to both audio and video content of the session, including the Musician’s performance, voice, likeness, and any communications exchanged during the session.
Users who wish to share their session for promotional, personal, or other purposes may request written permission from Sessions Boutique by contacting info@sessionsboutique.com. Approved requests will be granted in writing and may be subject to conditions, including proper attribution and restrictions on monetization. A Musician's or Provider's personal consent to being recorded or shared does not constitute authorization under these Terms. Only written approval from Sessions Boutique, LLC is valid. Any recording made based solely on a Musician's permission, without Sessions Boutique's written consent, remains a violation of these Terms.
30.4 Prohibited: Bad-Faith Recording, Defamation, and Competitive Misuse
The following conduct is strictly prohibited and constitutes a material breach of these Terms:
- Deliberately manufacturing, staging, or provoking a negative session experience for the purpose of recording and publishing it to damage Sessions Boutique’s reputation, its Musicians, or its Services.
- Recording or capturing any session content for the purpose of competitive intelligence, reverse engineering the platform’s processes, or providing material advantages to any competing business or platform.
- Publishing, distributing, or sharing any unauthorized recording of a session — in whole or in part — on any platform, social media channel, website, or through any other means.
- Using session recordings to misrepresent, defame, or disparage Sessions Boutique, its employees, Musicians, Providers, or any other party connected to the Services.
- Accessing or booking sessions under false pretenses, including impersonation, false identity, or misrepresentation of purpose, with the intent to record, surveil, or gather information for competitive or harmful purposes.
Violations of this section may result in immediate and permanent termination of the User’s account without refund, and may expose the User to civil and/or criminal liability under applicable laws governing defamation, unfair competition, intellectual property, and unauthorized recording.
30.5 Ownership of Session Recordings vs. Delivered Files
The live session recording — meaning any video, audio, or multimedia capture of the session event itself, including performances, communications, and interactions — is and remains the exclusive property of Sessions Boutique, LLC. This is distinct from the final audio files, stems, or other deliverables produced during the session, which are licensed to the User under the terms described elsewhere in these Terms of Service.
No User, Musician, or Provider acquires any ownership right in the session recording itself by virtue of participating in a session.
31. Customer Support
Sessions Boutique provides customer support to Users through the support tools available inside The Studio app. Users may contact support for account-related questions, technical issues, session coordination matters, and other inquiries related to the Services.
Support Hours
Customer support is generally available Monday through Friday, during regular business hours (approximately 9:00 AM to 5:00 PM Eastern Time — New York Time), excluding U.S. federal holidays and any other closures communicated through the platform.
No Guaranteed Response Time
Sessions Boutique does not guarantee any specific response time for support inquiries. While we make reasonable efforts to respond promptly during standard business hours, response times may vary and cannot be guaranteed. Inquiries received outside of standard support hours — including evenings, weekends, and holidays — will be addressed during the next available business hours. Sessions Boutique is under no obligation to provide support outside of standard business hours.
Best Efforts; No Liability for Delays
Sessions Boutique will use commercially reasonable efforts to respond to support inquiries in a timely manner. However, Sessions Boutique shall not be liable for any losses, damages, missed opportunities, project delays, or other consequences arising from a delay in responding to a support request, regardless of the cause of the delay. Support response times, whether faster or slower than expected, shall not constitute a failure of the Services or a basis for any refund, credit, or compensation.
From time to time, Sessions Boutique staff may respond to inquiries outside of standard business hours as a courtesy. Such responses do not create an obligation to provide after-hours support on a continuing basis and do not modify or expand Sessions Boutique's standard support commitments in any way.
32. Changes to Terms
We may update these Terms at any time.
Significant updates will be announced via the app or by email.
Continued use of the app after updates constitutes acceptance of the revised Terms.
